These Terms & Conditions ("Terms") govern the use of the bgcut.net website, web application, API, browser extensions and plugins (the "Service") provided by Webmint s.r.o. ("we", "us"). By creating an account, uploading an image or purchasing credits you agree to these Terms.

1. Provider

2. The Service

bgcut.net removes backgrounds from images using automated AI models. Results are generated automatically and may be imperfect; you can refine them with the provided tools. The Service is provided "as is" for both consumers and businesses.

3. Accounts

You must provide a valid e-mail address and keep your password and API keys confidential. You are responsible for all activity under your account and API keys. One person may hold one free account. We may suspend accounts used for abuse, fraud, automated scraping of the free tier or violations of these Terms.

4. Free usage and credits

  • Previews are free. Registered users may download up to 5 images per calendar month at a maximum size of 640 px free of charge.
  • Full-resolution ("HD") downloads require credits. One credit unlocks one image; once unlocked, re-downloading the same image with different settings during its retention period is free.
  • Credits are sold in packages at the prices shown on the pricing page. Prices are in US dollars, exclusive of VAT, which is added at checkout according to your billing country.
  • Credits do not expire, are non-transferable and have no cash value. Failed processing is never charged.
  • Credits received through the affiliate program or promotional bonuses are subject to the same rules.

5. Payments, invoices and refunds

Payments are processed by Stripe. Before the first purchase you must provide billing details (name, address, country; optionally company name, company ID and VAT ID). An electronic VAT invoice is issued automatically and available in your account. Right of withdrawal: consumers in the EU may withdraw from the purchase of unused credits within 14 days without giving reasons by e-mailing [email protected]; by starting to use purchased credits you expressly agree that the digital service begins immediately and acknowledge that the withdrawal right is lost to the extent credits have been used. Refunds for unused credits are also granted to business customers within 14 days. Refunds are made to the original payment method.

6. Your content

You retain all rights to the images you upload and to the results. You grant us a limited licence to store and process them solely to provide the Service. You warrant that you have the necessary rights to the images and that they do not infringe the rights of others or applicable law. You must not upload unlawful content, content depicting child sexual abuse, non-consensual intimate imagery, or content that violates third-party privacy or intellectual-property rights. We may remove such content and terminate accounts.

7. Acceptable use

You must not: circumvent credit or quota limits; reverse-engineer, resell or wrap the Service as your own without our written consent (API resale requires an agreement); overload or disrupt the Service; use automated tools against the web interface (use the API instead); or use the Service to create deceptive media intended to harm others.

8. API and integrations

API access is subject to rate limits (currently 60 requests per minute per key) and the same credit rules. We may change endpoints with reasonable notice; the current documentation is at bgcut.net/api-docs. Browser extensions and plugins are provided free of charge and may be updated or discontinued.

9. Affiliate program

Registered users may share a personal referral link and earn 30% of the net credit purchases of referred users, as described on the affiliate program page. Commissions mature 14 days after the purchase, are cancelled if the purchase is refunded, and are paid out above the minimum threshold via the chosen method. Self-referrals, brand-name paid search, spam and misleading promotion are prohibited and lead to forfeiture of commissions.

10. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features. If we discontinue the Service entirely, unused purchased credits will be refunded pro rata.

11. Warranty and liability

To the extent permitted by law, the Service is provided without warranties of any kind. We are not liable for indirect or consequential damages, loss of profit or data. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability for intent, gross negligence, death or personal injury, or mandatory consumer rights.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. Consumers also enjoy the mandatory protection of the law of their country of residence. Consumers in the EU may use the Czech Trade Inspection Authority (ČOI, www.coi.cz) for out-of-court dispute resolution or the EU online dispute resolution platform at ec.europa.eu/consumers/odr. Courts of the Czech Republic have jurisdiction for business customers.

14. Changes to these Terms

We may update these Terms. The current version is always published at bgcut.net/terms; material changes will be announced in advance. Continued use after the effective date constitutes acceptance.
